EVENT TERMS AND CONDITIONS
1. Use of Space
A. Liability - The Exhibitor is entirely responsible for the space leased and shall not injure, mark, or deface the premises including driving any nails, tacks, hooks, or screws in any part of the building. Exhibitor shall not affix to the walls or windows of any building advertisement, signs, etc. The Exhibitor agrees to reimburse the facility and/or decorator, for any loss or damage to the premises or equipment occurring in the space leased to the Exhibitor. Event Management and their sponsors shall not be liable for failure to perform its obligations under this contract as a result of strikes, acts of God, or any causes beyond its control.
B. Space - The space contracted is to be used solely for the Exhibitor whose name appears on the contract and it is agreed that the Exhibitor will not sublet or assign any portion of the space without written approval from Event Management. In the event the Exhibitor fails to occupy or use the space or to have their exhibit completed and in place one hour prior to the opening of the Event, they shall forfeit their right to the space, and all prepaid rent, and upon demand pay any rental balance owing to Event Management. At the point Event Management may reassign the booth space.
C. Aisles - Aisles, passageways and overhead spaces remain strictly under the control of Event Management, and no banners, signs, materials, or decorations will be permitted in them except by written permission from Event Management and Venue. All Exhibitors and personnel must remain within the confines of their own assigned space and no Exhibitor will be permitted to erect signs or display products in such a manner as to obstruct the view of other Exhibitors. No interference with the light or space of another Exhibitor will be permitted.
D. Demonstrations - Promotional activities must be confined within the limits of the Exhibitors assigned space. Noise resulting from the exhibit space must not interfere with other Exhibitors in any way.
E. Food Items - No food items or drinks are to be sold for purposes of on-premise consumption without prior, written consent. Any items, beverages or samples intended for on-site consumption must conform to a sampling policy and requires written permission from Event Management and facility concessions, if offered.
F. Balloons - No helium balloons are permitted inside unless approved by Event Management and Venue prior the event.
G. Restrictions - The Event Management reserves the right to restrict or remove exhibits, without refund,
that may be falsely entered, or may be deemed by the management unsuitable or objectionable. This restriction applies to noise, persons, animals, things, conduct, printed material, or anything of a character that might be objectionable to the event or the Event Management
H. Offenders - Any offenders may be asked to leave the area if any of the above are violated and as an exhibitor offender, no refund will be give to the offender.
2. Rules for Exhibits:
A. Booths - All booths and decorations must concur with the venue regulations, city ordinances, and fire codes. Any violations may result in the removal of any materials found to be in violation. Materials for booth decorations and construction must be fire retardant. Contact the Event Management if at all in doubt.
B. Representative - Absolutely NO booths can be left unmanned during the event.
C. Installations - Any special wiring, electrical, carpentry, or other work, shall be installed at the Exhibitors expense and is subject to the approval of the Event Management.
D. Licenses - Any and all city, county, state or federal licenses, inspections or permits as required by law of any Exhibitor in the installation or operation of its display shall be obtained by the Exhibitor at their own expense prior to the opening of the event.
E. Rights of Management - Event Management shall not be liable for any damages or expenses incurred by Exhibitor in the event the show is delayed, interrupted or not held as scheduled. If, for any reason, beyond the control of the Event Management the show is not held, Event Management may retain the amounts paid by the Exhibitors as is necessary to defray expenses already incurred by the Event Management.
F. Terms and Conditions - This contract contains all the terms and conditions agreed on by the parties hereto, and no other agreements, oral or otherwise regarding the subject matter of this contract, shall be deemed to exist or to bind any of the parties hereto.
G. Security for Rental - Failure on the part of the Exhibitor to pay rental as specified under the contract shall entitle Event Management to seize all materials, displayed by the Exhibitor within the described even and to retain the same as security for any unpaid rental amount owing.
H. Amendments - Exhibitor agrees to abide by decisions of the Event Management concerning all matters pertaining to the administration and success of the event which are not specifically stated.
I. Attorney Fees - In the event suit or action is brought by Event Management under this agreement to enforce any of its terms, it is agreed that as the prevailing party, Event Management shall be entitled to reasonable attorney fees to be fixed by the trial and appellate courts.
3. Security- We will try to provide the best security possible for the protection of your exhibit properties. However, Playgroups USA, WeeBoogie Event Management, Venue Management or our Insurance Company is financially liable for losses or mysterious disappearances of any kind. We recommend that all Exhibitors contact their insurance agents to confirm proper coverage of exhibit materials. (Please read carefully the coverage provided by decorators and shipping companies to determine if additional coverage is necessary.)
4. Cancellation - Any cancellations or changes must be in writing and received by our office no later than 30 days prior to the event date. No REFUNDS will be made and subject to a $250 penalty for each cancelled booth space.
5. Exhibitor List - All exhibitors may provide names of up to four company personnel that will be able to enter the venue in advance for set-up. These names will be held at the check-in area for advance set-up the day before and early entry the day of the event, so please have your identifications ready.
6. Liability - Neither Playgroups USA or WeeBoogie, Event Management, the venue each individual event takes place at and their residing city/county, the Events Decorator, Event Sponsors, Service Contractors, not their representatives, not any member of the above names will be responsible for any injury, loss or damage that
may occur to the exhibitor or the exhibitor's employees or property from any cause whatsoever.
The Exhibitor, on signing the contract, expressly releases the aforementioned from any all ALL claims for such loss, damages or injuries.
7. Insurance Requirements - During the term of this Agreement, Exhibitor shall procure and maintain Comprehensive General Liability insurance, which shall include contractual liability coverage, with limits of not less that 1,000,000 per occurrence for bodily injury and property damage combined single limit.
Exhibitors will ONLY be allowed to breakdown their booths after the close of the event. Out of courtesy, we urge you not to dismantle your booths in advance as this disrupts traffic flow and the enjoyment of the event. Exhibitors that breakdown early may not be able to participate in future events.
